Search McDowell County Criminal Dockets

Start your McDowell County criminal court docket search by figuring out which court level holds the case: Magistrate Court, Circuit Court, or a municipal court. West Virginia runs separate statewide search paths for Magistrate and Circuit matters, so the answer shapes where you look. The clerk of each court remains the source for documents and certified copies. One caution matters throughout. A charge, a hearing event, and the final result are distinct parts of a court record, and a good McDowell County criminal docket search keeps them separate.

MCR and McDowell Criminal Dockets

The official MCR instructions describe searching by first and last name or by case number. A result can show the McDowell County location, filing date, case type, agency, and charge information. It may also list an appearance date, plea, disposition, and chronological events. Those fields identify a case. They do not include the underlying pleadings or orders.

Suppose MCR finds the McDowell County criminal docket but not the paper you need. Write down the case ID and event date. Then contact the Magistrate Clerk. Say whether you want a complaint, an order, a disposition document, or another named filing. Ask whether an ordinary or certified copy is required. Also confirm the current charge and delivery method before sending payment. The portal warns that its information may be incomplete or inaccurate. Confirm any future appearance date with the court.

Note: An MCR match identifies case information. It does not provide the filed document or guarantee that a displayed setting remains current.

McDowell Criminal Dockets: What They Show

A McDowell County criminal court docket is a dated index of case activity, and each field plays a limited role. The charge states the alleged offense. The plea records a response. The disposition states the recorded outcome. An event can show that a motion was filed or a hearing occurred without revealing how the judge ruled. When an entry references an order, the signed order controls its exact terms.

Case IDThe official MCR sample uses 25-M17F-00437; formats vary, so use the actual number shown on the record.
Case LocationThe county and court associated with the record, which helps separate McDowell Magistrate and Circuit matters.
ChargeCharge text, classification, and related agency data when displayed; it is an allegation, not a conviction.
Appearance DateA listed setting that should be checked against later events and confirmed with the clerk.
PleaThe plea entered in the proceeding, kept distinct from the charge and disposition.
DispositionThe recorded result when present; consult the judgment or dismissal order for controlling language.
EventsThe chronological register of filings, hearings, bond activity, orders, and other docket steps.

A blank field is not an answer. The item may not apply, may not yet be entered, or may be restricted. For recent McDowell County docket activity, check against the clerk's file.

McDowell Criminal Filing Context

The West Virginia Judiciary's annual reports offer measured context for McDowell County Circuit Court. The 2024 report lists 205 new criminal filings: 105 felonies, 4 Magistrate appeals, 1 misdemeanor, and 95 matters in the official "other criminal" category. The 2025 report lists 187: 89 felonies, 2 Magistrate appeals, 5 misdemeanors, and 91 other criminal matters.

2052024 Circuit criminal filings
1872025 Circuit criminal filings
892025 felony filings

Read these figures carefully. They count annual new filings. They are not pending McDowell County criminal dockets, convictions, dismissed cases, or people. "Other criminal" is a report category, not an assumed charge type. The Judiciary also labels its live dashboards preliminary and near real time. Annual reports are the more stable source for year-based comparisons.

Criminal Case Stages on the Docket

A McDowell County prosecution may begin before a magistrate. The start can bring a complaint, warrant, bail decision, and initial proceedings. In a felony matter, the Magistrate Court can hold a preliminary examination. Circuit Court handles the felony trial and sentencing stage. One prosecution can therefore leave a Magistrate record plus a later Circuit docket. The two entries relate to each other but are not duplicate views of one file.

Docket flow: Complaint or charge › initial appearance › preliminary examination when required › Circuit filing or indictment › pretrial settings › plea or trial › disposition and sentencing.

Not every McDowell County criminal docket follows every step. A waiver, dismissal, plea, continuance, or other order can change the route. Read the last event and the filed order rather than assuming the first setting held.

Reading McDowell Criminal Docket Terms

Several terms on a McDowell County criminal docket look alike but answer different questions. Keeping them apart prevents the most common error: treating the charge line as the final judgment.

Charge
The offense alleged in the complaint, citation, information, or indictment.
Plea
The defendant's formal response to a charge; it is not the same field as the result.
Disposition
The recorded outcome of a charge or case, which should be read with the controlling order.
Appearance date
A scheduled court appearance shown in MCR, subject to later reset or cancellation.
Bond release
A docket event about bond status; the underlying order gives the exact terms and effect.

A dismissal entry and a conviction entry carry different legal meanings. A deferred event is not interchangeable with either one. When precise language matters, request the criminal judgment or other signed order from the McDowell County clerk that holds the case.

McDowell County Criminal Docket Courts

Two courts write the criminal docket in McDowell County. West Virginia Magistrate Courts take misdemeanors, warrants and complaints, bail setting, and preliminary examinations in felony cases. Above them sits the Circuit Court. That court holds general criminal jurisdiction over felony trials and sentencing, and it also reviews appeals from Magistrate and Municipal Court. McDowell County shares the Twelfth Judicial Circuit with Wyoming County.

Municipal CourtCity-ordinance cases where a municipality provides a courtThe municipal recorder or clerk; no central McDowell city portal was located

Match the court to the record first. A failed MCR query never reaches WVPASS, a municipal office, or federal court, so turn to the county's docket search instructions for a wider lookup workflow.

WVPASS Circuit Criminal Documents

WVPASS opened to the public in March 2025. It covers West Virginia Circuit Court records. The FAQ says users can search public McDowell County Circuit information. They can pull public documents filed from July 1, 1999 onward. Registration is free. Browsing case detail costs nothing, while public document downloads run $0.25 per page. Two limits matter. WVPASS sends no case notifications, and its downloads are not certified copies.

For a recent felony event, line up the docket history against the newest filed order. Is the document missing, too new, restricted, or needed in certified form? Then send a focused request to McDowell County Circuit Clerk Francine Spencer. Give the case number and the document title or event date. State whether you want an ordinary or certified copy. A mailed or counter request can also ask about an older paper attachment. It may now sit archived outside the portal.

Note: WVPASS coverage starts on its stated filing date. But public access still depends on sealing, confidentiality, and document availability.

Access Rules for Criminal Dockets

West Virginia law leans toward openness, with firm limits. Under West Virginia Code §51-4-2, any person may inspect court records, and clerks must provide copies when required. That rule bends to stronger ones. A sealing order, an expungement, juvenile restrictions, family-file confidentiality, and limits on abuse-and-neglect records all still control.

Key access rules:

West Virginia Code §61-11-26 provides a process for eligible criminal expungements and gives an expungement order a sealing effect.

West Virginia Code §53-8-17 defines sealing for covered mental-hygiene records and limits the routes for access.

Trial Court Rule 15A.24 limits private identifiers in filings and places redaction duties on the filer.

"Not found," "sealed," "confidential," and "expunged" are not the same thing. A McDowell County criminal docket can also be absent for ordinary reasons. The wrong court was searched. A name or case number was mistyped. The entry is new, or online coverage simply does not reach that far back, so ask the proper clerk what public access allows without pressing for restricted details.

Certified McDowell Criminal Docket Copies

Online docket data helps you find the case. Only the clerk issues the official copy. Route a Circuit record request to the McDowell County Circuit Clerk. Send a Magistrate record request to Magistrate Clerk Andrea Fowler. Name the court and the case number. Give the filing or event date, the exact document, the copy type, and how you want delivery. The clerk need not summarize an open file by phone. Staff can still explain the practical route for inspection and copies.
